INscribe MyIGA Hypermedia API License Agreement

An application programming interface (“API”) is now available to make it easier for developers to build new ways of interacting with public information generated by the Indiana General Assembly and otherwise available at www.in.gov/legislative (collectively known as “INscribe”).

The following terms of service govern use of the API and INscribe developer resources web pages and services from the Legislative Services Agency (“LSA”). These are offered subject to your acceptance of the terms and conditions contained on this web page as well as any relevant sections of the INscribe site and privacy policies (collectively, the “Agreement”). Access to or use of the API or INscribe services or its content constitutes acceptance to this Agreement. If you are entering into this Agreement on behalf of a company or other entity, you represent and warrant that you have authority to bind such company or other entity to this Agreement.

Scope

The API and all other content, documentation, code, and related materials made available to you through INscribe services are subject to these terms.

Registration and Use of API Access Tokens

In order to use the API, you must register with LSA through the developer web page and receive appropriate API credentials (an “API Access Token”). You must not sell or otherwise share your API Access Token, must keep your API Access Token secure, and must use it as your sole means of accessing the API. You may not require your users to obtain their own API access token to use your Application.

Privacy

Personal information collected by registration or use of INscribe is confidential and will be used only for the management of the INscribe system.

Secondary Use

Data accessed through the API do not, and should not, include controls over its end use, except as provided by law or this Agreement. However, as the data owners or authoritative sources, the Indiana General Assembly and its officers, offices, agencies, and departments providing the data retain version control. Once the data has been downloaded from INscribe, the State of Indiana (including the Indiana General Assembly, LSA, and its constituent officers, offices, agencies, and departments) cannot vouch for the quality and timeliness of any analyses conducted with data retrieved.

IC 2-5-1.1-13 governs use of all or a part of video or audio coverage, or both, over the Internet or another broadcast medium of any of the following:

  1. Sessions of the General Assembly.

  2. Other legislative activities authorized by the Legislative Council.

Citing Data

Users of the API should cite the date that data were accessed or retrieved using the API. Finally, users must clearly state that “INscribe and the Indiana General Assembly cannot vouch for the data or analyses derived from these data after the data have been retrieved from INscribe.” State, Indiana General Assembly, or INscribe logos may not be used by persons who are not employees of the State of Indiana or on products (including Web pages) that are not sponsored by the State of Indiana (including the Indiana General Assembly, LSA, and its constituent officers, offices, agencies, and departments).

Be a Good Citizen

You share INscribe with your fellow members and developers. Write your Application as you’d want others to write theirs.

  • Only ask for the minimum data fields your application needs to work properly.

  • Don’t try to exceed or circumvent your limitations on calls and use. This includes creating multiple applications for identical, or largely similar, usage (e.g. having one application per customer). If we believe that you have exceeded or circumvented our limitations, or if you have tried to, we may temporarily suspend or permanently block your access to the APIs, disable your developer account, or both.

  • Don’t download, scrape, post, or transmit, in any form or by any means, any part of INscribe.

  • Don’t copy, reformat, reverse-engineer, or otherwise modify the APIs, Access Credentials, the INscribe Website or any Content.

  • Don’t interfere with or disrupt INscribe services or servers or networks connected to INscribe services, or disobey any requirements, procedures, policies or regulations of networks connected to INscribe services.

Public Participation

Recommendations from individuals, groups, and organizations regarding the presentation of data, data types, and metadata are encouraged to contribute to the evolution of INscribe.

Modification or False Representation of Content

You may not modify or falsely represent content accessed through INscribe and still claim the source is INscribe.

Right to Limit

Use of the APIs may be subject to certain limitations on access, calls, or use as set forth within this Agreement or otherwise established by LSA. If LSA reasonably believes that you have attempted to exceed or circumvent these limits, your ability to use the API may be permanently or temporarily blocked.

LSA may monitor your use of its services to improve the services or to insure compliance with this Agreement.

Service Termination

If you wish to terminate this Agreement, you may do so by refraining from further use of the services. LSA reserves the right (though not the obligation) to, with or without prior notice:

  1. refuse to provide the services to you, if it is LSA’s opinion that your use violates any LSA policy, or

  2. terminate or deny you access to and use of all or part of the services at any time for any other reason in its sole discretion.

Any hosted applications may also be shut down or removed. All provisions of this Agreement which by their nature should survive termination shall survive termination including, without limitation, warranty disclaimers, indemnity, and limitations of liability.

Changes

LSA reserves the right, at its sole discretion, to modify or replace this Agreement, in whole or in part. Your continued use of or access to INscribe services following posting of any changes to this Agreement constitutes acceptance of those modified terms. LSA may, in the future, offer new services and/or features. Such new features and/or services shall be subject to the terms and conditions of this Agreement.

Disclaimer of Warranties

INscribe services are provided “as is” and on an “as-available” basis. The State of Indiana (including the Indiana General Assembly, LSA, and its constituent officers, offices, agencies, and departments) hereby disclaim all warranties of any kind, express or implied, including without limitation the warranties of merchantability, fitness for a particular purpose, and non-infringement. The State of Indiana (including the Indiana General Assembly, LSA, and its constituent officers, offices, agencies, and departments) makes no warranty that the services will be error free or that access thereto will be continuous or uninterrupted.

Limitations on Liability

In no event will the State of Indiana (including the Indiana General Assembly, LSA, and its constituent officers, offices, agencies, and departments) be liable with respect to any subject matter of this Agreement under any contract, negligence, strict liability or other legal or equitable theory for: (1) any special, incidental, or consequential damages; (2) the cost of procurement of substitute products or services; or (3) interruption of use or loss or corruption of data.

General Representations

You hereby warrant that: (1) your use of the services will be in strict accordance with the INscribe privacy policy, this Agreement, and all applicable laws and regulations, and (2) your use of the services will not infringe or misappropriate the intellectual property rights of any third party.

Indemnification

You agree to indemnify and hold harmless the State of Indiana (including the Indiana General Assembly, LSA, and its constituent officers, offices, agencies, and departments), its contractors, employees, agents, and the like from and against any and all claims and expenses including attorney’s fees, arising out of your use of the APIs, including but not limited to violation of this Agreement. This Indemnification clause does not apply to government entities.

Miscellaneous

This Agreement constitutes the entire Agreement between LSA and you concerning the subject matter hereof, and may only be modified by the posting of a revised version on this WEB page by LSA.

Disputes

Any disputes arising out of this Agreement and access to or use of the services shall be governed by the law of Indiana, without regard to principles of conflict of law.

No Waiver of Rights

LSA’s failure to exercise or enforce any right or provision of this Agreement shall not constitute waiver of such right or provision.
